EB-3 Visa Requirements

EB-3 Visa Application Process
Employers file the Form I-140 Petition for Alien Worker on behalf of the applicant. Employers must prove their continued ability to pay the proposed salary with a priority date. An annual report, federal income tax return, or an audited financial statement is acceptable evidence.
EB-3 requires the employer to file the PERM application process and maintain a labor certification (Form ETA-9089) showing that no other American is willing or qualified to fill the position.

For skilled workers
- You must have at least 2 years of work or training experience.
- Relevant post-secondary education may be considered training
- You must work in a role for which qualified U.S. employees are unavailable.
For professionals
- You will be filling a role for which there are no skilled workers available in the US
- You must have sufficient work experience in your professional field.
- You must have a bachelor's degree from a US college or an equivalent foreign degree from any country.
For unskilled or other workers
- You need to fill a role for which there are no workers available in the US
- You should be able to perform non-seasonal and permanent unskilled labor
EB-3 Visa Documents
- You have an international passport that is valid for at least 6 months.
- You must have two passport-size photographs matching the US visa
- Complete Form I-140 and Form I-907, if applicable
- Form I-140 and Form I-907 payment receipts, if you are applicable
- Birth certificate
- Government-issued identification, such as a driver's license
- Labor Certification from the US Department of Labor
- Employer job offer
- Educational qualification documents
- Tax payment document
How do I apply for an EB-3 visa?
- You will receive an approved application for Permanent Labor Certification from the U.S. Department of Labor (if required for a specific visa category.)
- You should Complete Form I-140.
- You should Deposit the filing fee.
- You should Present evidence.
- You will Sign and file Form I-140.
Once USCIS receives the Form I-140, the petition will be processed and the employer will then receive confirmation that it has been received. The employer will also be well informed of the decision.How long is the EB3 visa valid?
The EB3 visa is a permanent residence visa, so it does not expire. This automatically qualifies you for a green card, also known as lawful permanent resident status.
EB3 Application Fee
The filing fee for Form I-140 is $700, while the fee for Form I-907 for premium processing is $2,500. As the petitioner, your employer will pay these fees, not you. Your employer must pay these fees before submitting the form.
